PRE-COUNCIL WORK SESSION, THURSDAY

CITY COUNCIL OF THE CITY OF ABILENE, TEXAS,

BASEMENT CONFERENCE ROOM, CITY HALL

The City Council of the City of Abilene, Texas, met in a Pre-Council Work Session on May 21, 1998, at 8:30 A.M. in the Basement Conference Room of City Hall. Mayor Gary D. McCaleb was present and presiding with Councilmen Paul R. Vasquez and A. Don Drennan, Councilwoman Carol Martinez, Councilmen Rob Beckham and Ray Ferguson, and Councilwoman Kay Alexander. Also present were City Manager Roy L. McDaniel, Assistant City Manager Mike Morrison, City Attorney Sharon Hicks, City Secretary Jo Moore, and various members of the City staff.

Roy McDaniel, City Manager, briefed the Council on various consent and regular agenda items. Vance Burton, Director of the YMCA, along with Ronnie Bryant and Stacy Hyde, gave a report of their Intensive Supervision Program, which is a remedial program targeted to help kids at risk. Mr. Burton reported that most referrals come from the Juvenile Justice probation office. Stacy Hyde gave an overview of what the program is about; stating it began in the 1970's and in the 80's evolved in education; serving children from ages 8-17, with most being from 10-14. Therapy is provided in several areas, along with social and physical activities. Funding is provided by the County at $2,083 per month (average $5.25 per day per child), $1,250 per month provided by the City (totaling $15,000 per year); and $80,000-85,000 per year from United Way. Ronnie Bryant stated these are high-risk kids, mostly referred by the juvenile probation, and feels the dollars are well spent. Chief Martin summed up the importance of the program, stating the program has been a mainstay, and part of the juvenile system here in Abilene. There being no further discussion, the meeting was recessed to the City Council Chambers until 9:00 a.m. for the regular Council Meeting.

REGULAR CITY COUNCIL MEETING

Mayor McCaleb reconvened the City Council of the City of Abilene, Texas, into Regular Session May 21, 1998, at 9:00 a.m. in the Council Chambers of City Hall.

Councilwoman Kay Alexander gave the invocation.

Pledge of Allegiance was led by Efrain Ortega, Shantere Snow, & Yvonne Vasquez, 3rd graders from the Title 1 Pilot Program at College Heights Elementary, who were accompanied by Merry Sue Stephens, Elementary Curriculum Coordinator for AISD.

Janet Ardoyno presented to Mayor McCaleb the Make A Difference Day Encore Award received by the City of Abilene. Ms. Ardoyno recognized students from the following schools: Second grade students from Mrs. Schelkenberg's class at Reagan Elementary, who spent a day at Care Inn with residents and planted flowers; Mrs. Fisk's students from Mann Middle School, Mrs. Jane Allred's Houston SAC students, whose contribution included a quilt presented to Governor Bush; and Alesia Orosco and Tanya Gripton from Bassetti Elementary, who were individual Encore Award winners and participants in the Children's World Summit in Paris, France.

Mayor McCaleb stated his and the Council's pride in the students and their efforts to make Abilene a better place to live.

Kay Berry, Abilene Clean & Proud, assisted Mayor McCaleb in presenting the Quarterly Recycling Award to Dennis Gloyna of Southwestern Bell and Linda Neal of AISD for Project ReDirectory. Mr. Gloyna then assisted Mayor McCaleb in the presentations to local schools who were the top collectors in Project ReDirectory, and gave special recognition to City employee Bill Brock.

Mayor McCaleb, assisted by Ms. Berry, presented the Quarterly Beautification award to Jennalee Latimer and Tim Dickerson, President of the Butternut Association for the Butternut Clean-Up project.

Mayor McCaleb presented a proclamation for May 24-30 as "Say So" Week.

Due to a prior commitment, Mayor McCaleb left the meeting, returning after the opening of Executive Session.

Janet Ardoyno gave a brief report on her representation of Abilene at the Texas Summit on Volunteerism. Ms. Ardoyno stated goals to be set for the next Make a Difference Day would be in the areas of: mentoring, safe places, health/nurturing in advancing from school to work and opportunities to serve.

DISPOSITION OF MINUTES

There being no corrections, additions, or deletions to the minutes of the Pre-Council Session and Regular City Council Meeting held May 7, 1998, Councilman Vasquez moved to approve the minutes as printed. Councilman Ferguson seconded the motion and the motion carried.

AYES: Councilmen Vasquez, Drennan, Ferguson, and Beckham, Councilwoman Alexander, and Mayor Pro Tempore Martinez.

NAYS: None.

CONSENT AGENDA

Councilwoman Alexander moved to approve consent agenda items 3.1 through 3.4 as recommended by the staff. Councilman Drennan seconded the motion and the motion carried.

AYES: Councilmen Vasquez, Drennan, Ferguson, and Beckham, Councilwoman Alexander, and Mayor Pro Tempore Martinez.

NAYS: None.

Resolutions:

3.1 Oral Resolution authorizing the City Manager to sign the agreement with Experimental Aircraft Association Southwest Regional Fly-In Inc. to conduct a Fly-In event at the Abilene Regional Airport during the third weekend in October 1998.

3.2 Oral Resolution authorizing the City Manager to execute a contract with Warren Associates, Inc. for Payroll Programming Assistance for the year 2000 in an amount not to exceed $22,300.

3.3 Oral Resolution approving a Letter of Intent to affiliate between Shackelford County and Abilene Regional MH/MR Center.

Award of Bid

3.4 Rehabilitation & reconstruction of Hardwick Road, Bid #CB8050. The bid was awarded to Abilene Roadway Construction for the unit prices bid with an estimated construction cost of $594,173.81, as recommended by staff.

REGULAR AGENDA

Ordinances

4.1 Don Henry, Economic Development, briefed the Council regarding an Ordinance removing designation of Tax Abatement Reinvestment Zone Number Four in accordance with the Texas Property Redevelopment and Tax Abatement Act, terminating the Agreement for Tax Abatement with Independent Grocers, Inc., effective December 31, 1997. Staff recommends approval.

Mayor Pro Tempore Martinez opened a public hearing on the item, and there being no one present and desiring to be heard, the public hearing was closed.

Councilman Vasquez moved to approve the Ordinance removing designation of Tax Abatement Reinvestment Zone Number Four in accordance with the Texas Property Redevelopment and Tax Abatement Act, terminating the Agreement for Tax Abatement with Independent Grocers, Inc., effective December 31, 1997, as recommended by staff. Councilman Beckham seconded the motion and the motion carried.

AN ORDINANCE OF THE CITY COUNCIL OF ABILENE, TAYLOR COUNTY, TEXAS, REMOVING THE DESIGNATION OF TAX ABATEMENT REINVESTMENT ZONE NUBMER FOUR IN ACCORDANCE WITH THE TEXAS PROPERTY REDEVELOPMENT AND TAX ABATEMENT ACT ("ACT"), TEX. TAX CODE ANN. 312.001 ET. SEQ.; AND TERMINATING THE AGREEMENT FOR TAX ABATEMENT WITH INDEPENDENT GROCERS, INC., AND CALLING A PUBLIC HEARING.

Other Business:

Mayor Pro Tempore Martinez recessed the Council into executive session pursuant to Sections 551.071 and 551.074 of the Open Meetings Act, to seek the advice of the City Attorney with respect to pending and contemplated litigation, and to consider the appointment and evaluation of public officers.

The Council reconvened from executive session and reported no action taken.
