PRE-COUNCIL WORK SESSION, THURSDAY

CITY COUNCIL OF THE CITY OF ABILENE, TEXAS,

BASEMENT CONFERENCE ROOM, CITY HALL

The City Council of the City of Abilene, Texas, met in a Pre-Council Work Session on January 14, 1999, at 8:30 A.M. in the Basement Conference Room of City Hall. Mayor Pro Tempore Carol Martinez was present and presiding with Councilmen Paul R. Vasquez, A. Don Drennan, Rob Beckham and Versie L. Brown, Jr., and Councilwoman Kay Alexander. Also present were City Manager Roy L. McDaniel, Assistant City Manager Mike Morrison, City Attorney Sharon Hicks, City Secretary Jo Moore, and various members of the City staff. Mayor Gary D. McCaleb was absent.

The Council briefly discussed various consent and regular agenda items. Staff pointed out that Item 4.1, Z-03998 – Add MX (Mixed Use Overlay) to underlying RM-3 (Residential Multi-Family) district located in the 3500 block of S. 14th Street, has been removed from the Regular Agenda due to a packet having been received by City staff containing protests by owners of 20% of the area of the land extending 200 feet from the proposed changes. A super majority vote by Council is now required on this item, and with Mayor McCaleb absent and Councilman Beckham abstaining, enough Councilmembers are not present for the required vote. City Manager Roy McDaniel briefed the Council on the Mixed Use Overlay designation and the administration procedures followed when a Mixed Use Overlay is requested. Item 4.2, Z-04498 – Rezone from O (Office) to GC (General Commercial) district located in the 1600 block of Sherman Drive, was also removed from the Regular Agenda at the request of the proponent. Tom Martin, City landscape architect, briefed the Council regarding the landscape enhancement project at the Treadaway and S. 1st Street intersection. Items remaining to be done on the project include more trees being planted, adding concrete block walls, updating and increasing the water system, and adding crepe myrtle beds. Completion of the project will not occur until around May, when the ground is warm enough for grass seed to be planted. Maintenance of the area will be shared between the State and the City with the State maintaining the trees and mowing, and the City weeding the shrub beds and watering the trees. Council stated their approval of the project. There being no further discussion, the meeting was recessed until 9:00 a.m. for the regular Council Meeting.

Mayor Pro Tempore Martinez reconvened the City Council of the City of Abilene, Texas, into Regular Session January 14, 1999, at 9:00 a.m. in the City Council Chambers of City Hall.

Councilman Versie L. Brown, Jr. gave the invocation.

Pledge of Allegiance was led by Luke Moropoulis, a fifth grader at Alta Vista Elementary who was accompanied by his principal, Jeff Brokovich and his mother, Judy Moropoulis.

Jo Moore, City Secretary, assisted Mayor Pro Tempore Martinez in presenting Employee Service Awards to the following individuals for their years of service:

There being no corrections, additions, or deletions to the minutes of the Pre-Council Session and Regular City Council Meetings held December 10 and 17, 1998, and Special Council Meeting of December 11, 1998; Councilman Vasquez moved to approve the minutes as printed. Councilman Brown seconded the motion and the motion carried.

AYES: Councilmen Vasquez, Drennan, Beckham, Brown, Councilwoman Alexander, and Mayor Pro Tempore Martinez.

NAYS: None.

CONSENT AGENDA

Councilman Brown moved to approve consent agenda items 3.1 through 3.5, and approval of first reading of consent agenda items 3.6 through 3.9, as recommended by the staff. Councilman Drennan seconded the motion and the motion carried.

AYES: Councilmen Vasquez, Drennan, Beckham, Brown, Councilwoman Alexander, and Mayor Pro Tempore Martinez.

NAYS: None.

Resolutions

    1. Oral Resolution approving a street use license request from McCathren Limited for the use of the Pine St. right-of –way at 226 Pine for construction of a permanent canopy.
    2. Oral Resolution approving a street use license request from McGee, Blanks, Alexander and Trull for the use of the S. 14th and Chestnut Streets right-of-way.
    3. Bid Awards

    4. Award of Worker’s Compensation Insurance for CityLink Transit, Bid CB-9030. The bid was awarded to First Southwest Insurance Agency for a two-year amount not to exceed $83,454 plus or minus audited payroll adjustments, as recommended by staff.
    5. Undercarriage for Caterpillar D6D Track Dozer, Bid CB-9026. The bid was awarded to West Texas Equipment, the low responsible bidder in the amount of $25,240 as recommended by staff.
    6. Traffic Sign material, Bid CB-9033. The bid was awarded on a per item basis for unit prices bid as follows: Items #1, #3, and #4 to 3M; and Item #2 to Vulcan Signs, as recommended by staff.

3.6 Approval of first reading - Z-05698 – Rezone from HC (Heavy Commercial) to CU (College-University) district located at 2510 Pine Street, and set a public hearing for January 28, 1999 at 9:00 a.m.

AN ORDINANCE AMENDING CHAPTER 23, "PLANNING AND COMMUNITY DEVELOPMENT," SUBPART E, "ZONING," OF THE ABILENE MUNICIPAL CODE, BY CHANGING THE ZONING DISTRICT BOUNDARIES AFFECTING CERTAIN PROPERTIES, AS DESCRIBED BELOW; DECLARING A PENALTY, AND CALLING A PUBLIC HEARING.

3.7 Approval of first reading - Z-00199 – Rezone from RM-3 (Residential Multi-Family) to AO (Agricultural Open Space) district located in the 2400 block of Vogel Avenue, and set a public hearing for January 28, 1999 at 9:00 a.m.

3.9 Approval of first reading - Ordinance to amend Chapter 11 "Food and Food Handlers" of the Abilene Municipal Code adopting by reference the Texas Food Establishment Rules 229161 et al and the Federal Current Good Manufacturing Practice in Manufacturing, Packing, or Holding Human Food, Code of Federal Regulations (CFR), Chapter 21, Part 110, and all amendments thereto and set a public hearing for January 28, 1999 at 9:00 a.m.

AN ORDINANCE AMENDING CHAPTER 11, "FOOD AND FOOD HANDLERS" OF THE ABILENE MUNICIPAL CODE BY: DELETING THE CURRENT CHATPER 11, "FOOD AND FOOD HANDLERS" AND ADOPTING A NEW CHAPTER 11, ARTICLES I, II, AND III AS SET OUT BELOW; PROVIDING A SEVERABILITY CLAUSE; DECLARING A PENALTY; ADOPTING BY REFERENCE THE TEXAS FOOD ESTABLISHMENT RULES 229161 et al AND THE FEDERAL CURRENT GOOD MANUFACTURING PRACTICE IN MANUFACTURING, PACKING, OR HOLDING HUMAN FOOD, CODE OF FEDERAL REGULACTIONS (CFR), CHAPTER 21, PART 110, AND ALL AMENDMENTS THERETO; AND, CALLING A PUBLIC HEARING.

REGULAR AGENDA

Ordinances

4.1 Z-03998 – Add MX (Mixed Use Overlay) to underlying RM-3 (Residential Multi-Family) district located in the 3500 block of S. 14th Street was removed from the Regular Agenda as reviewed during the Pre-Council Worksession to be considered at a later date.

4.2 Z-04498 – Rezone from O (Office) to GC (General Commercial) district located in the 1600 block of Sherman Drive was removed from the Regular Agenda at the request of the proponent.

Mayor Pro Tempore Martinez recessed the Council into executive session pursuant to Sections 551.071 and 551.074 of the Open Meetings Act, and to seek the advice of the City Attorney with respect to pending and contemplated litigation and to consider the appointment and evaluation of public officers.

The Council reconvened from executive session and reported no action taken.

Councilman Drennan moved to approve the appointment of Vic Overman to fill a term expiring 5/99 on the Electrical Subcommittee. Councilman Beckham seconded the motion and the motion carried.

AYES: Councilmen Vasquez, Drennan, Beckham, Brown, Councilwoman Alexander, and Mayor Pro Tempore Martinez.

NAYS: None.

There being no further business, the meeting was adjourned at 10:30 a.m.
