CITY COUNCIL OF THE CITY OF ABILENE, TEXAS,

BASEMENT CONFERENCE ROOM, CITY HALL

The City Council of the City of Abilene, Texas, met in a Pre-Council Work Session on October 12, 2000, at 8:30 a.m. in the Basement Conference Room of City Hall. Mayor Grady Barr was present and presiding with Councilmen Norm Archibald, Kris Southward, Victor Carrillo, Rob Beckham, and Councilwoman Kay Alexander. Also present were City Manager Roy L. McDaniel, Assistant City Manager Michael Morrison, City Attorney Sharon Hicks, Acting City Secretary Debbie Hurley, and various members of the City staff. Councilman Versie L. Brown, Jr. was absent.

Roy McDaniel, City Manager, introduced Bob Cheatham, Parks Supervisor, who briefed the Council on the Parks Division functions. Mr. Cheatham distributed to and reviewed with the Council handouts of Park properties. Following Mr. Cheatham's presentation, Mr. McDaniel briefed the Council on various consent and regular agenda items. There being no further discussion, the meeting was recessed to the City Council Chambers until 9:00 a.m. for the regular Council Meeting.

Mayor Barr reconvened the City Council of the City of Abilene, Texas, into Regular Session October 12, 2000, at 9:00 a.m. in the City Council Chambers of City Hall.

Councilman Rob Beckham gave the invocation.

Pledge of Allegiance was led by Kortney McDow, fifth-grader at Bassetti Elementary. Kortney was accompanied by his parents, James and Sharon McDow.

Mayor Barr and Keep Abilene Beautiful Chair Malcolm Bramlett presented the Keep Abilene Beautiful Business and Industry Quarterly Awards as follows: Beautification and Landscaping to Dyess AFB Golf Course, Litter Control to Goodwill Industries Road Crew, and Special Award to Pine Street Salvage.

Mayor Barr asked Richard Gertson, Director of Community Development, to come forward and brief the Council on the Sears Neighborhood Best Practice Award. Mr. Gertson introduced HUD Representatives Louis Ybarra and Warner Endsley, Planning staff Elizabeth Grindstaff and Virginia Owen, and neighborhood committee members Joel Loya, Billy Enriquez.

Mayor Barr presented the following Proclamations:

October 12 as Mental Health Awareness Day 2000 and

October 28, 2000 as Make a Difference Day.

DISPOSITION OF MINUTES

Councilman Carrillo noted moved to approve the minutes of the September 28, 2000 Pre-Council and Council Meeting as printed. Councilwoman Alexander seconded the motion and the motion carried.

AYES: Councilmen Archibald, Southward, Carrillo, Beckham, Brown, Councilwoman Alexander, and Mayor Barr.

NAYS: None.

CONSENT AGENDA

Councilman Brown moved to approve consent agenda item 3.1 and first reading of item 3.2. Councilman Carrillo seconded the motion and the motion carried.

AYES: Councilmen Archibald, Southward, Carrillo, Beckham, Brown, Councilwoman Alexander, and Mayor Barr.

NAYS: None.

Ordinances

3.1 Approval of final reading - Ordinance amending Chapter 18, "Motor Vehicles and Traffic" of the Abilene Municipal Code.

The Ordinance is numbered 45-2000 and is captioned as follows:

AN ORDINANCE AMENDING CHAPTER 18, "MOTOR VEHICLES AND TRAFFIC", OF THE ABILENE MUNICIPAL CODE, BY AMENDING CERTAIN SECTIONS AS SET OUT BELOW; PROVIDING A SEVERABILITY CLAUSE; AND DECLARING A PENALTY.

3.2 Approval of first reading - TC-04800 - Thoroughfare abandonment of the cul-de-sac radius of Bratton Court located on Bratton Court west of Lincoln Dr., and set a public hearing for October 26, 2000 at 9:00 a.m.

AN ORDINANCE PROVIDING FOR THE ABANDONMENT OF A PORTION OF PUBLIC RIGHT OF WAY; PROVIDING FOR THE TERMS AND CONDITIONS OF SUCH ABANDONMENT, AND CALLING A PUBLIC HEARING.

REGULAR AGENDA

Ordinances

4.1 Councilman Beckham moved to remove from the table Z-04700 - Rezone from RS-6 (Residential Single Family) to HI (Heavy Industrial) zoning district property located in the 1800 block of Texas Street. Councilman Brown seconded the motion and the motion carried.

AYES: Councilmen Archibald, Southward, Carrillo, Beckham, Councilwoman Alexander, and Mayor Barr.

NAYS: None.

authorize the City Manager, by Oral Resolution, to execute a Water Treatment Contract with the City of Hamlin to sell and provide treated water for municipal purposes from January 1, 2001 through December 31, 2041, as recommended by the Planning & Zoning Commission.

AYES: Councilmen Archibald, Southward, Carrillo, Beckham, Councilwoman Alexander, and Mayor Barr.

NAYS: None.

AN ORDINANCE AMENDING CHAPTER 23, "PLANNING AND COMMUNITY DEVELOPMENT," SUBPART E, "ZONING," OF THE ABILENE MUNICIPAL CODE, BY CHANGING THE ZONING DISTRICT BOUNDARIES AFFECTING CERTAIN PROPERTIES, AS DESCRIBED BELOW; DECLARING A PENALTY, AND CALLING A PUBLIC HEARING.

Other Business

There being no further business, Mayor Barr recessed the Council into executive session pursuant to Sections 551.071, 551.072 and 551.074 of the Open Meetings Act, to seek the advice of the City Attorney with respect to pending and contemplated litigation, and to consider the purchase, exchange, lease, or value of real property, and to consider the appointment and evaluation of public officers.

The Council reconvened from executive session and reported no action taken.

There being no further business, the meeting was adjourned at 2:00 p.m.
